Two exemptions to the Digital Millennium Copyright Act in 2010 clearly state that both Jailbreaking and unlocking your phone is legal inside the United States. However, both amendments to the DMCA are set to expire and be re-evaluated in 2012 (just two short years after the amendments were added).
